PARTICIPANT AGREEMENT, RISK ACKNOWLEDGEMENT AND WAIVER FORM
AXE IT is a franchised brand, and this waiver form (“Waiver”) captures all AXE ITS’, including stores which are run by franchisees who are not part of the owner operated group. This Waiver also acts to exclude all liability of the AXE IT parent company (Glazed and Confused), and all associated and group companies of which the company operating each store is a part of.
This is an important document: please read carefully before signing (by tapping the ‘Submit Waiver(s)’ button) below.
Before participating at AXE IT, all participants must register to participate by completing their personal details below. Participants must be over the age of 18 to participate in axe throwing; persons under 18 years of age may participate subject to someone who has parental responsibility for the minor completing this Waiver on their behalf. ID may be required. You will not be allowed to participate in any Activity without signing this Waiver and unless we are sure that you are over 18.
If you are signing on behalf of a child under 18 years of age, by signing this Waiver you are releasing AXE IT from all liability whatsoever including the right for any claim to be bought by the minor, or anyone on behalf of the minor in the future.
In order to participate in axe throwing and all other activities and games housed within AXE IT (collectively herein called “Activities”) organised by or on behalf of AXE IT, its agents, owners, directors, shareholders, officers, directors, principals, volunteers, participants, clients, customers, invitees, employees, independent contractors, insurers, facility operators, land and/or premises owners and any and all other persons and entities acting in any capacity on its behalf (collectively “AXE IT” also known as “the Company”), I agree as follows:
- I am 18 years old or older.
- I agree that I will undertake the Activities in accordance with the safety rules and advice made available to me prior to participation in the pre-participation safety briefing, together with any oral instructions or advice given to me prior to or during the session. I agree to follow the directions of AXE IT, its management, and staff at all times. I acknowledge that I am responsible for my own safety (and the safety of my possessions) (and any children within my group) while undertaking the Activities.
- I certify that to the best of my knowledge that I am in good physical health, and I do not have any medical condition which might have the effect of making it more likely that I will be involved in an incident which could result in injury to myself or others. I certify that I have no pre-existing medical conditions or disabilities which, through participation in the Activities, could result in damage to my health or that of others.
- I will communicate anything necessary to the venue and work with staff to find a safe way to participate. I acknowledge that there might be occasions where participation is not possible.
- If in any doubt as to your ability to participate safely in the Activities, please seek advice from your GP and you must not participate in any Activity.
PARTICIPANT’S ACKNOWLEDGMENT
I confirm that I accept that I will be refused access to the activity if it is deemed that I am incapable of participating safely due to intoxication and or unsafe behaviour. I also acknowledge that I will not be permitted to consume any alcohol whilst participating in the axe throwing activity.
- I understand that AXE IT does not assess the abilities of individual participants or the suitability of the Activities for use by individual participants. I further understand that all participants must make their own assessment of whether the Activities are suitable for use by individual participants and individual participant’s ability to participate in the Activities prior to use.
- I understand that the Activities are used by multiple groups at the same time and are not restricted to any one age group. I understand that the Activities are physically demanding and throwing axes can result in unpredictable occurrences. I understand that the Activities demand extreme caution at all times.
- I understand that the Activities are dangerous and there is a risk of personal injury when undertaking such Activities and participation can result in serious injury or death. I use the Activities entirely at my own risk. I understand that participation in the Activities can result in personal injury including, but not limited to cuts, abrasions, bruising, muscle strains, twists, sprains, dislocation, broken bones and paralysis and I accept that these injuries can occur through general use of the equipment and not as a result of defective equipment or negligence of the Company.
- I understand and accept that the Activities require a moderate level of fitness and can be physically demanding and require physical effort and I should not undertake the Activities unless I am physically able to.
- I understand that I am responsible for my own actions and or involvement in using the Activities.
- I understand that AXE IT does not provide expert training or tuition to participants in the use of the Activities.
- I understand that AXE IT does not assess any participant’s skill levels, abilities, competency, or the suitability of the Activities for use by them. I understand that I must always pay attention to the instructor.
- In the event of an accident, or loss or damage to any personal effects, I acknowledge that the Company will not be liable for any direct or indirect loss, damage or injury arising from or in connection with the Activities (except for death or personal injury caused by the Company’s negligence), or with my/our failure to comply with the safety instructions and/or directions of AXE IT and I waive all and any claims against the Company in this respect.
USE OF PERSONAL DATA & IMAGES
By entering AXE IT and participating in the Activities, I hereby consent to AXE IT taking photographs and/or recording me in connection with AXE IT and using the photograph and/or recording for all purposes, including advertising and promotional purposes. I waive my right to inspect or approve the use of the photograph and/or recording and acknowledge and agree that the rights granted to this release are without compensation of any kind. I understand that I may withdraw this consent at any time by advising AXE IT, contact details for whom can be found in the Privacy Policy referred to below.
- I also acknowledge that AXE IT will retain an electronic copy of this Waiver and the personal details I have recorded in it for a period of three years and two months from the date of this Waiver. This is separate to all rights and obligations relating to GDPR.
- I acknowledge that I have read and fully understand the above prior to my signing below and I confirm acceptance of AXE IT Rules, terms and conditions and Privacy Policy.
- I am personally responsible for my own well-being and that of any children within my group.
- I confirm that I am not under the influence of drugs or alcohol to such an extent to be intoxicated or unsafe to participate in Activities. I accept that I must not participate in any Activities where either staff at the venue have advised in the relevant safety briefing or otherwise, or where signage confirms a prohibition on alcohol or drug consumption prior to attending. I acknowledge and accept that CCTV images of all park entrants will be monitored and recorded throughout the premises for the purposes of public safety and crime prevention. I acknowledge that I have been provided with safety rules and advice of the Company in relation to the Activities and that I have read and fully understand the above and accept the terms of participation freely and voluntarily without any inducement prior to signing/submitting this form.
ACTIVITY RULES
I agree that I shall not participate in any activities or use any equipment provided by AXE IT unless I have undertaken AXE IT’s safety induction procedures and processes in relation to the activities and confirm that I will comply with the following rules at all times whilst on the premises in relation to axe throwing:
- Always throw forwards at the designated target
- Never throw if anyone else is in the axe throwing enclosure
- Never enter the axe throwing enclosure if someone else is throwing
- Always be vigilant and sensible
BY CLICKING THE ‘ACCEPT ALL’ BUTTON BELOW, I CONFIRM MY FULL AGREEMENT TO THE ABOVE AND I WAIVE ALL RIGHTS THAT I MAY OTHERWISE HAVE IN RELATION TO ANY LOSS OR PERSONAL INJURY SUFFERED EITHER DIRECTLY OR INDIRECTLY BY VISITING A AXE IT WHETHER OR NOT I PARTICIPATE IN ANY ACTIVITIES.
